These Terms & Conditions ("Terms") govern your access to and use of the Kalani Clinic website, products, services and online booking system. By accessing our website, purchasing products, booking an appointment, attending a consultation or receiving treatment from Kalani Clinic, you acknowledge that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy and any other policies published on our website.

If you do not agree with these Terms, you should not use our website or services.

Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law or any other legislation that cannot lawfully be excluded.

Throughout these Terms, references to "Kalani Clinic", "we", "our" or "us" mean Kalani Beauty Pty Ltd.

Our Services

Kalani Clinic provides professional laser, skin and beauty treatments together with the sale of professional skincare and cosmetic products.

All treatments are performed following an individual consultation and assessment. Recommendations are based on your skin condition, medical history, treatment goals and our professional judgement at the time of consultation.

Because every client is different, not every treatment is suitable for every person.

We reserve the right to refuse, postpone or discontinue any treatment where we reasonably believe it is not clinically appropriate, where it may compromise your safety or the safety of our practitioners, where a satisfactory outcome is unlikely to be achieved, or where treatment would otherwise be inconsistent with professional standards.

This includes, but is not limited to, situations involving undisclosed medical conditions, pregnancy where relevant to the treatment, active skin infections, open wounds, contagious illnesses, recent sun exposure, medications that may affect healing, intoxication, aggressive or inappropriate behaviour, failure to follow pre-treatment instructions, or circumstances where informed consent cannot be properly obtained.

Our practitioners will always act in what they reasonably believe to be your best interests.

Eligibility

Clients must be capable of providing informed consent before receiving treatment.

Clients under 18 years of age must attend with a parent or legal guardian. The parent or legal guardian must provide consent before any consultation or treatment is carried out.

We may request identification where reasonably necessary.

Medical Information

Your safety depends on the accuracy of the information you provide.

Before receiving treatment, you agree to provide complete and accurate information regarding your medical history, medications, allergies, previous cosmetic procedures, skin conditions, pregnancy or breastfeeding status and any other information that may affect your suitability for treatment.

You must also advise us if your medical history changes between appointments.

Kalani Clinic relies on the information provided by you when determining treatment suitability. To the extent permitted by law, we are not responsible for adverse outcomes arising directly from inaccurate, incomplete or misleading information supplied by a client.

Consultations

Some treatments require a consultation before treatment can proceed.

A consultation is designed to assess your concerns, discuss your goals, explain suitable treatment options and identify any contraindications.

Recommendations are based on the information available at the time of consultation and may change if your skin condition, medical history or circumstances change.

Attendance at a consultation does not guarantee that treatment will be recommended or performed.

Where we believe a treatment is unsuitable or not in your best interests, we may recommend an alternative treatment or decline to provide treatment altogether.

Consent

Before receiving treatment you may be required to complete consultation forms, medical history questionnaires and treatment consent documentation.

By proceeding with treatment, you acknowledge that the proposed treatment has been explained to you, including its intended purpose, expected benefits, limitations, possible side effects, potential risks and alternative treatment options where appropriate.

You acknowledge that you have had the opportunity to ask questions and that those questions have been answered to your satisfaction before treatment commences.

Treatment Results

Every person's skin responds differently to treatment.

Treatment outcomes vary according to factors including age, skin type, genetics, hormones, medications, lifestyle, sun exposure, smoking, home skincare, compliance with aftercare instructions and individual healing responses.

For this reason, Kalani Clinic cannot guarantee specific results, treatment outcomes or the number of treatments required to achieve your desired result.

Any treatment plans, estimated treatment numbers or anticipated timeframes discussed during consultation are professional estimates only and should not be interpreted as guarantees.

Photographs, testimonials, reviews and before-and-after images published by Kalani Clinic are provided for illustrative purposes only. They represent the experience of individual clients and should not be relied upon as an indication of the results that any other client may achieve.

Client Responsibilities

Clients play an important role in achieving safe and effective treatment outcomes.

You agree to follow all pre-treatment and aftercare instructions provided by Kalani Clinic, attend review appointments where recommended and promptly notify us of any unexpected reactions or concerns following treatment.

Failure to follow professional advice may reduce treatment effectiveness, increase the likelihood of complications or affect healing.

Where treatment outcomes are affected because recommended instructions have not been followed, Kalani Clinic accepts no responsibility for the resulting reduction in treatment effectiveness to the extent permitted by law.

Appointments

Appointments are reserved exclusively for each client.

We ask that you arrive on time to allow sufficient time for consultation, preparation and treatment.

If you are running late, please contact us as soon as possible.

Where a late arrival significantly reduces the available treatment time, Kalani Clinic may shorten the treatment, reschedule the appointment or decline to perform the treatment where doing so would compromise safety, treatment quality or the experience of other clients.

We may decline future bookings where there has been repeated non-attendance, repeated late cancellations, abusive behaviour, non-payment or repeated failure to comply with these Terms or other clinic policies.

Cancellations and Appointment Changes

We understand that plans can change. If you need to cancel or reschedule your appointment, we ask that you provide at least 48 hours' notice.

Appointments cancelled, rescheduled or not attended within 48 hours of the scheduled appointment time may incur a cancellation fee. Where a fee applies, Kalani Clinic reserves the right to charge the fee, retain any prepaid amount or require full or partial prepayment before accepting future bookings.

If exceptional circumstances have prevented you from attending your appointment, please contact us as soon as possible. Any waiver of cancellation fees is at the sole discretion of Kalani Clinic.

Pricing and Payment

All prices are quoted in Australian Dollars (AUD) and include GST where applicable.

Prices, promotions, treatment availability and product ranges may change without notice.

While every effort is made to ensure pricing accuracy, Kalani Clinic reserves the right to correct pricing, typographical, promotional or website errors before accepting a booking or processing an order.

Payment is required on the day of your appointment unless otherwise agreed in writing.

We accept the payment methods displayed in the clinic or on our website. Outstanding balances must be paid before further appointments or purchases may be made.

Treatment Packages

Treatment packages are designed to provide multiple treatments over a recommended treatment period.

Unless otherwise stated in writing, treatment packages are valid for 12 months from the date of purchase.

Packages are issued to the individual client who purchased them and are not transferable to another person or another clinic. They cannot be exchanged for cash, refunded for change of mind or split between multiple individuals.

Where a treatment becomes unsuitable due to changes in your medical history or clinical circumstances, Kalani Clinic may, at its discretion, substitute the remaining value of your package with another suitable treatment or clinic credit where appropriate.

Unused treatments remaining after the expiry date will expire unless an extension has been approved by Kalani Clinic in writing before the package expiry date.

Gift Cards

Gift cards are valid for three (3) years from the date of purchase unless a longer period is required by law.

Gift cards cannot be redeemed for cash, reloaded, refunded after purchase (except where required under Australian Consumer Law), or replaced if lost, stolen, damaged or used without your permission.

Gift cards may only be redeemed for eligible products and services offered by Kalani Clinic.

Retail Products

Kalani Clinic stocks professional skincare and cosmetic products from carefully selected brands.

Please choose carefully, as we do not offer refunds or exchanges for change of mind.

If you believe a product is faulty, damaged or incorrect, please contact us as soon as reasonably practicable after receiving it. We will assess your request and provide a repair, replacement or refund where required under the Australian Consumer Law.

Nothing in these Terms limits your statutory consumer rights.

Promotions and Special Offers

From time to time, Kalani Clinic may offer promotions, introductory offers, package pricing or promotional discounts.

Unless otherwise stated, promotional offers:

cannot be used in conjunction with any other offer;

cannot be applied retrospectively;

are not redeemable for cash;

are not transferable to another individual; and

are available only during the advertised promotional period.

Kalani Clinic reserves the right to amend, extend or withdraw promotional offers at any time, provided doing so does not affect rights that have already accrued.

Photography

With your consent, Kalani Clinic may take clinical photographs before, during or after treatment to assist with treatment planning, monitor progress and maintain accurate clinical records.

Clinical photographs form part of your confidential client record.

Photographs will only be used for advertising, marketing, educational or promotional purposes where you have provided your express consent.

You may withdraw your consent for future marketing use at any time by contacting us. Withdrawal of consent does not require Kalani Clinic to remove material already lawfully published before consent was withdrawn.

Website Use

The information published on our website, social media channels and other marketing material is provided for general educational and informational purposes only.

It is not intended to replace professional medical advice, diagnosis or treatment.

You should not rely solely on website information when deciding whether a treatment is appropriate for you. Individual recommendations should always be based on a personal consultation with a qualified practitioner.

While Kalani Clinic makes reasonable efforts to ensure website content is accurate, we do not warrant that all information is complete, current or free from error.

Intellectual Property

Unless otherwise stated, all content appearing on the Kalani Clinic website, including text, graphics, branding, logos, treatment information, photographs, videos, designs and layout, is owned by or licensed to Kalani Clinic and is protected by Australian intellectual property laws.

You may access this website for your personal, non-commercial use only.

You must not reproduce, publish, modify, distribute, sell or otherwise exploit any website content without our prior written consent.

Limitation of Liability

To the maximum extent permitted by law, Kalani Clinic excludes liability for any indirect, incidental, consequential or special loss arising from the use of our website, products or services.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy available under the Australian Consumer Law or any other legislation that cannot lawfully be excluded.

Where liability cannot be excluded, Kalani Clinic's liability is limited to the remedies available under the Australian Consumer Law.

Privacy

Kalani Clinic collects, stores and uses personal information in accordance with our Privacy Policy and applicable Australian privacy laws.

By using our website or services, you consent to the collection, use and disclosure of your personal information as described in our Privacy Policy.

Force Majeure

Kalani Clinic will not be liable for any delay, cancellation or failure to perform its obligations where such delay or failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, pandemics, government restrictions, power outages, equipment failure, supplier interruptions, internet or telecommunications failures or staff illness.

Where reasonably practicable, we will contact affected clients and arrange an alternative appointment.

Changes to These Terms

Kalani Clinic may amend these Terms & Conditions from time to time to reflect changes in our services, legal obligations or business practices.

The most current version will always be published on our website and will apply to bookings, purchases and use of our services made after the updated Terms have been published.

Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia.

Any dispute arising in connection with these Terms or the services provided by Kalani Clinic will be subject to the exclusive jurisdiction of the courts of New South Wales.
